NMVA Liability Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT. BY COMPLETING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ THIS CONTRACT CAREFULLY.

Group Organizer’s Name: National Minor Volleyball Association, hereinafter to be referred to as “NMVA”. This includes member associations in Winnipeg and Guelph. 

ASSUMPTION OF RISKS: I am aware that participation in sports, without limitation, offered by or associated with NMVA and its affiliate programs, exposes my child to many inherent risks. By engaging my child in these activities, I freely accept and fully assume all inherent risks, dangers, and hazards and the possibility of personal injury, death, property damage or loss resulting there from.

RELEASE OF LIABILITY WAIVER OF CLAIMS & INDEMNITY AGREEMENT: In consideration of WMVA and its affiliate programs providing my child with the opportunity to participate in their activities, permitting him/her the use of its equipment and the use of facilities, I hereby agree as follows:

TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against NMVA and its affiliate programs, as well as their directors, officers, employees, agents, representatives, assigns and successors.

T0 RELEASE NMVA and its affiliate programs, as well as all their directors, officers, employees, agents, representatives, assigns and successors from any and all liability for any loss, damage, injury or expense that I or my child may suffer as a result of his/her participation in activities and sports offered by NMVA and its affiliate programs; due to any cause whatsoever INCLUDING NEGLIGENCE, BREACH OF CONTRACT, BREACH OF STATUTORY DUTY OF CARE, AND/OR BREACH OF THE OCCUPIER'S LIABILITY ACT, ON THE PART OF NMVA AND ITS AFFILIATE PROGRAMS as well as its directors, officers, employees, agents, representatives, assigns and successors.

TO HOLD HARMLESS AND INDEMNIFY NMVA AND ITS AFFILIATE PROGRAMS, and all their directors, officers, employees, agents, representatives, assigns and successors from any and all liability for any property damage or personal injury to any third party, resulting from my child’s activities and his/her participation in the activities offered by or associated with NMVA.

That this Agreement shall be effecting and binding upon any heirs, next of kin, executors, administrators and assigns in the event of my death.

I have read and understand this Agreement. I am aware that by clicking the "I Accept" button on the NMVA "On-line Registration Form" as well as by printing the Registraion Form and mailing it in with my personal cheque, I am waiving certain legal rights which I or any heirs, next of kin, executors, administrators and assigns may have against NMVA and its affiliate programs as well as their directors, officers, employees, agents, representatives, assigns and successors.

PERSONAL INFORMATION: I understand that the NMVA and its affiliate programs are collecting certain personal information about my child, me and other members of my family. I also understand that this information will be used only for the purpose of administrating NMVA and affiliated programs. I hereby consent to such collection, use and disclosure of this personal information.

I also authorize the NMVA and its affiliated programs to take photographs of my son/daughter during their participation in the sport to display them and otherwise use these photos without charge solely for the purpose of promotional material in connection with the NMVA. These may be for print ad, display on their web site, or other promotional use as the organization may determine.
